General Note

The lease includes a schedule of regulations at Schedule 4. These include (these are edited versions): –

  • The flat may only be used for residential purposes. That does not mean you may not work from home but you cannot run a business from your flat
  • A ban on any ‘illegal or immoral act or any act or thing which may be or become a nuisance or annoyance or cause damage to the Lessors or the tenants of the Lessors or the occupiers of any part of the Estate or of any adjoining or neighbouring premises’.
  • Not to do or permit to be done any act or thing which may render void or voidable any policy of insurance maintained in respect of the Estate or may cause an increased premium to be payable in respect thereof nor to keep or permit to be kept any petrol or other inflammable substances in or about the Demised Premises
  • Not to throw or permit to be thrown any dirt rubbish rags or other refuse into the sinks baths lavatories cisterns or waste or soil pipes in the Demised Premises.
  • Not to play or use or permit the playing or use of any musical instrument television radio loudspeaker or mechanical or other noise making instrument of any kind nor to practise or permit the practicing of any singing in the Demised premises
  • (a) Between the hours of eleven p.m. and eight a.m. or
  • At any other time or times so as to cause any nuisance or annoyance to any of the other owners tenants or occupiers of the Building
  • Not any time to put on or in any window or balcony (if any) or on the exterior of the Demised Premise so as to be visible from outside any name writing drawing signboard plate placard or advertisement of any kind whatsoever or any unsightly object or anything which in the opinion of the Lessors is offensive
  • Not to hang your washing outside windows or balconies
  • Not to keep any bird reptile dog or other animal on the Demised Premises without the previous consent in writing of the Management Company
  • Not to obstruct any paths or passages with cars or bikes
  • Not to allow children to play in the hallways (!)
  • Carpet your floors
  • Make no noise between 2300 and 0800
  • Remove forthwith upon being so required by the Management Company or its Managing Agents any object of or obstruction … in the Common Parts and to pay to the Management Company on demand the cost incurred by them in removing and if appropriate storing the same which removal and storage
  • Each morning to empty any rubbish of the previous day suitably wrapped into the refuse receptacles or other means of refuse disposal (if any) provided by the Management Company

Under the Lease either Caledonian Roofdwellers or the Management Company may issue new regulations as they: –

… in their absolute discretion think fit to make for the management care and cleanliness of the Estate and the comfort safety and convenience of all the occupiers thereof PROVIDED THAT in so deciding the Lessors and the Management Company shall first consider the views and wishes of the majority of the Flat Owners

New regulations on a range of subjects have been issued. These include, and these are also set out in full in the Google Drive documentation,: –

  • Certification of gas and electrical supplies
  • Fitting of smoke and fire detectors
  • Administration fees for late payment of ground rent or service charge
  • Administration fees for unauthorised alterations
  • A ban on e-bikes and their batteries
